I got very irritated. A man had been hit on the head by boxes falling off a high shelf. There were wooden boxes that had been piled up there and a number of them fell from I forget how many feet. Anyhow they hit him with sufficient force that he had a concussion and he bled from the ears, nose and mouth, which are the earmarks of a concussion, he was taken to the hospital and soon seemed to have come out of the physical manifestations of a concussion, but according to the testimony of his mother, father and all the others he never got back his ability to do anything or keep his attention on anything. In other words, while not deranged he was mentally inadequate from that time on. He had been a stock clerk in this store and a clerk has to have a reasonably good mind to keep track of what the inventory is, where things are, what goes out and that sort of thing.

The company brought in an enormous line of medical testimony. This case was going to be expensive. This man was a young man not much over twenty-five or twenty-six years old. If we held that his mental disability was the result of the concussion, it would probably mean a total, permanent disability, because he probably never would get well if he hadn't after a full year had elapsed. He would never recover full mental control. So they fought it hard. They brought in very impressive mental testimony.
