Clark:

Only indirectly. You know, he was not well. I met him at a reception for Hastie. I asked him about his health. He said then that he and [Justice William] Brennan had made a pact that they were going to stay alive, and stay on that court. I notice that Brennan practically said the same thing a week or so ago.

Q:

Yes, and hasn't Brennan been coming out, in the last several months, one time quite recently, with some criticisms of the Court.

Clark:

They are both quite sensitive to the fact that they almost of the last of the liberals. But there's [Justice Harry] Blackmun, whom I've been watching very carefully. Was Blackmun appointed by Nixon?

Q:

Yes.

Clark:

I thought so. He's holding his own on basic civil liberties and civil rights issues.

Q:

Perhaps another demonstration how his Supreme Court Justice is going to vote with.

Clark:

I must tell you that Mr. Reagan goes to great lengths to know. His only appointee has been Sandra Day O'Connor.

Q:

Yes that's correct.

Clark:

Who is voting more often with Rehnquist than Burger is voting
