the issues in that strike. The other plan was a purely advisory board. We had those both drawn up. It would be a matter of high Presidential policy in the end to decide which should be done. Both of those would need executive orders. There was no law by which they could be don. The Secretary of Labor had no such powers, and the Conciliation Service, curiously enough, then believed—and I think the law creating it had this in mind—that it couldn't go in unless their conciliators were invited. We got ever that hurdle by asking to be invited. It was, “You want us to come, don't you, yes?”

There had been this Council of National Defense, and the President in 1940 created this Advisory Commission to the Council of National Defense. The members of the Cabinet had talked about this revival of the National Defense Council. We recognized that every member of the Cabinet was a member of that, and that it was a convenient device if emergency powers were to be granted by the Congress to anybody. They could be granted to these responsible officials. We had talked about that privately. It had been mentioned occasionally in Cabinet meeting, and the composition of the council was mentioned more than once. Nothing was ever said about who was to be added to it, or how.
